These Terms of Service ("Terms") govern your use of the IndexFit mobile application and related services (collectively, the "Service"). By downloading, accessing, or using IndexFit, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use IndexFit. You are responsible for activity that occurs under your account and for keeping your sign-in credentials secure. You agree to provide accurate information and to keep it up to date.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use IndexFit on Apple-branded devices that you own or control, solely for your personal, non-commercial use, in accordance with the App Store Terms of Service and the Usage Rules set forth in Apple's Media Services Terms and Conditions.

3. Subscriptions & payments

IndexFit offers a free tier with a 3-month workout trial and a paid subscription, "IndexFit Pro." Pro is available monthly or annually, with discounted pricing for verified students.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period at the then-current price.
  • You can manage or cancel your subscription in your Apple ID account settings after purchase.
  • Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple in accordance with its policies; we generally cannot issue refunds directly.

4. Health disclaimer

IndexFit provides fitness tracking, scoring, and informational content. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any exercise program, and stop and seek medical attention if you experience pain, dizziness, or discomfort. You use the Service and any AI-generated routines at your own risk and are solely responsible for your training decisions.

5. Acceptable use

You agree not to:

  • Falsify, manipulate, or game workout data, scores, or leaderboards.
  • Harass, abuse, threaten, or impersonate other users in chats, groups, or leagues.
  • Post unlawful, infringing, hateful, or sexually explicit content.
  • Attempt to access, scrape, reverse engineer, or disrupt the Service or its infrastructure.
  • Use the Service to violate any applicable law or third-party rights.

We may remove content and suspend or terminate accounts that violate these Terms.

6. Your content

You retain ownership of the content you create or submit (such as messages, profile details, and imported routines). You grant IndexFit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely to operate and provide the Service. You are responsible for ensuring you have the rights to any content you submit, including workouts you import from third-party platforms.

7. AI features

AI-generated routines, suggestions, and responses are provided for convenience and may be inaccurate or incomplete. They do not constitute professional, medical, or training advice. You should use your own judgment and consult a professional where appropriate. We are not liable for outcomes resulting from reliance on AI-generated content.

8. Intellectual property

The Service, including its software, design, logos, and the IndexFit name, is owned by IndexFit and protected by intellectual property laws. Except for the limited license above, no rights are granted to you. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

9. Termination

You may stop using IndexFit and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that scores and data will be perfectly accurate.

11. Limitation of liability

To the maximum extent permitted by law, IndexFit and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us, if any, in the 12 months before the event giving rise to the claim.

12. Apple-specific terms

This section applies because IndexFit is distributed through the Apple App Store:

  • These Terms are between you and IndexFit only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims.
  • Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes

We may update these Terms from time to time. When changes are material, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
